It's difficult to tell if the clip is curved or if it simply looks curved because of the lighting. This could be a cheap modern (as in post 1980s) fountain pen (perhaps a school pen), an even cheaper mass-market modern rollerball, or possibly an antique.
It looks like it might be hard rubber rather than plastic, which means it could conceivably be a Parker Jack-Knife or Duofold. It's not too far off from the Waterman 52 or 7, though the clip isn't right for that. There were a great number of black hard rubber pen makers before the 1940s so it could be a generic, unknown or vanished brand. My money is on cheap and modern.
Perhaps when the owner finishes The Great Gatsby he will meditate on the foolishness of building a persona from his possessions, and then we can all bid on his neat little flask on ebay.
